Senator Jennings Challenges Unapproved Land Records Fee

On February 24, 2025, the Maryland State Archives presented the Senate’s Health & Human Services Subcommittee – part of the Senate Budget & Taxation Committee, with an unexpected fee for accessing land records, drawing sharp criticism.

Senator J.B. Jennings expressed concern after learning of the newly imposed $0.20 per page viewing fee by the Maryland State Archives (MSA), stating “the Maryland State Archives bypassed the General Assembly and enacted a fee that was neither authorized nor approved.

Determining a fair and reasonable fee structure is the responsibility of the legislature, not state agencies acting unilaterally and placing unnecessary financial burdens on Maryland residents.

”Senator Jennings is calling for the immediate removal of the fee, arguing that it was implemented without proper legislative approval and in direct contradiction to the established legislative process.

While awaiting a formal opinion from the Attorney General on the legality of the Maryland State Archives’ action, Senator Jennings is working to ensure the public still has access to land records without incurring the new charge.

In response to his inquiry, the Attorney General’s Office confirmed that, although the MSA will charge a fee for online access, land records remain freely available at the MSA search room in Annapolis, as well as at circuit court clerk’s offices and public libraries across the state.

Senator Jennings remains committed to promoting public access and transparency, while ensuring that any future changes to public records access are handled through an open and accountable legislative process.
